Poison star Bret Michaels is taking legal action against a concert promoter after the “Every Rose Has Its Thorn” crooner showed up expecting to perform at an Upstate New York Music Festival only to be told that the concert had been cancelled, Syracuse.com has learned.

Michaels arrived at the CNY Regional Market in Syracuse, New York on Aug. 5 with his crew in tow but was promptly told that his performance had been postponed. The show’s promoter, Michael Banks, insists he axed the show because he found out Michaels was due to appear on NBC’s America’s Got Talent on the same night. As it turns out, the rocker’s appearance was pre-recorded.

On Monday, Michaels filed suit against Banks and Aloha Events in US District Court in New York for “breaching his contract and exposing him to public contempt and ridicule with allegedly defamatory statements about his schedule.”

Bret is seeking $5 million in damages.
