In a legal victory for cancer-stricken actor Michael Dougals, a New York judge has dismissed Diandra Luker-Douglas’ bid to get her hands on half of her ex-husband’s earnings from the fall box office drama Wall Street 2: Money Never Sleeps.

After 23 years of marriage, the former couple divorced in 2000. At the time, they agreed on a settlement which allowed Diandra to receive a share of the money he made from his movies while they were married. It’s a deal that’s earned Luker $6.3 million over the past decade — but she claimed she should receive money from Wall Street 2 as well, since the film revived the character Gordon Gecko, who Michael played in the original Wall Street in 1987. Luker had demanded 40 percent of the money the 66-year-old actor earned from the Oliver Stone film, but Manhattan Supreme Court Judge Matthew Cooper ruled New York was not the correct venue for the action because the then-couple divorced in California. Luker now has the option of refiling her petition there.

“He’s thrilled. This is the right decision. This action should have never been brought in the first place,” Marilyn Chinitz, an attorney for Douglas remarked after Monday’s ruling.

Douglas has been wed to fellow Oscar winner Catherine Zeta-Jones for almost 10 years.
