Practically all Internet users who have their personal e-mail boxes complain about unwanted e-mail messages, or simply spam. Of course, there are some special spam filters designated to block spam, however not all “junk” mail is blocked. We decided to find out whether it is illegal or not to send out such random messages from “nonsense” domain names.
According to the USA laws, namely to the CAN-SPAM Act, forged, misrepresented or falsified headers are beyond the law.
A class-action suit was brought against Vonage by a deputy DA, Craig E. Kleffman, in LA. According to him, it was header misrepresentation to use nonsense domains. Furthermore, it was impossible to say for sure judging from those addresses that spam was sent from Vonage or from its affiliate companies.
Regarding some facts about spam in different countries we see that in some countries as in the USA it is possible for direct marketers to avoid filters applying some tricks. In terms of law some of such messages will be even deemed as legal. In such countries as China, Russia and etc. no legal regulations have been introduced to struggle with spam. Luckily, in other countries, anti-spam laws have been elaborated and are already in force.
